The Khamovnichesky Court of Moscow recognized the claims of a blogger from the city of Ulyanovsk Denis Korkodinov against the search engine Yandex as groundless. The young man demanded to recover from the company 10 million rubles for the fact that it uses the slogan "There is everything."
Denis Korkodinov accused Yandex of deliberately spreading false information by the company - the search engine cannot find everything, the advertising slogan used is misleading users. Also, the blogger was not satisfied with the work of filters in a well-known search engine. According to him, filtering leads to the fact that many sites that fully comply with Russian legislation are not indexed. And this, in turn, violates the constitutional rights of users. As an example, the plaintiff cited his website, some pages of which were missing from the search results. The blogger estimated the moral damage caused to him at ten million rubles.
It should be noted that the work of search engines is based on the use of algorithms created taking into account the interests of Internet users, and not site owners. By entering his query into the search engine line, the user expects to receive exactly the information he is interested in. At the same time, site owners are interested in the traffic of their resources and their position in the search results. As a result, various methods are used to increase the ranking of a site, ranging from SEO optimization to buying inbound links. The filters used in the Yandex search engine are precisely designed to reduce the influence of artificial methods of increasing a site's position in search results - which, of course, annoys many owners of Internet resources.
The result of the trial was not in favor of the blogger. The judge of the Khamovnichesky court, Igor Kananovich, considered the slogan "There is everything", placed on the logo of the search engine, not as part of advertising, but as a design element. In addition, the user agreement posted on the Yandex home page contains a clause warning that the search engine should be used “as is,” with all its existing advantages and disadvantages.
In response to the judge's decision, Korkodinov said that he did not intend to give up and would appeal, since, in his opinion, the judge simply regretted Yandex. In turn, representatives of the company noted that they were satisfied with the court's verdict. A spokesman for the company, Ochir Mandzhikov, said that Yandex had no intention of misleading users.
The phrase, which has become the subject of litigation, is on the main page of the search engine, slightly below the main logo. Yandex periodically changes it - for example, in protest against the introduction of a register of prohibited resources, the company crossed out the word “all” for some time.
